2. Introduction
These Terms and Conditions of Sale and Use ("T&Cs") govern all contractual relationships between ANTIKARTS and any individual or entity making a purchase or using the website. Any order implies full and complete acceptance of the T&Cs.
3. Definitions
- Client: Any individual or entity making a purchase.
- Consumer: An individual acting for non-professional purposes.
- Professional: An individual or entity acting within their professional activity.
- User: Any person browsing the website.
- Order: Any confirmed act of purchase by the Client.
- Products: Artworks, antiques, decorative or digital items offered for sale.
- Company: Refers to ENYWERE – ANTIKARTS.
4. Purpose and Scope
These T&Cs define:

- Terms for ordering, payment, and delivery
- The rights and obligations of the Parties
- Applicable legal warranties
5. Registration and User Account
- Available to any adult with legal capacity.
- Each User guarantees the accuracy of the information provided.
- Login credentials are strictly personal.
- The Company may suspend or delete any fraudulent or non-compliant account.
6. Products and Availability
- Each product is described in detail (origin, condition, size, price).
- Photos are non-contractual but reflect essential characteristics.
- Stock is limited: the Company will notify the Client of unavailability.
7. Prices and Payment Terms
- Prices are in euros, VAT included, excluding delivery fees.
- Accepted payment methods: credit card, bank transfer, PayPal, cheque (France only).
- Payment is due in full at the time of order, unless otherwise stated.
- Late payments incur legal interest and a €40 recovery fee (for professionals).
8. Orders and Contract Formation
- The order becomes binding upon confirmation and payment.
- Confirmation is sent via email.
- The Company reserves the right to reject abnormal or fraudulent orders.
9. Delivery
- Average delivery time is communicated at the time of the order.
- Delivery available in France and internationally via partner carriers.
- Shipping costs and risks are the Client's responsibility once handed to the carrier, except for Consumers protected by the French Consumer Code.
10. Right of Withdrawal (Consumers)
- Legal withdrawal period of 14 days, in accordance with Articles L221-18 and following of the French Consumer Code.
- Exclusions: customized goods, perishables, unsealed goods for hygiene reasons, public auctions, digital content started before expiration with consumer’s consent.
11. Claims and Returns
- Claims must be made in writing within 14 days.
- The Company will examine and offer a solution (replacement, credit, or refund).
12. Legal and Commercial Warranties
- Legal conformity warranty (Articles L217-3 to L217-20 of the French Consumer Code).
- Warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
- Additional commercial warranties may be offered by ANTIKARTS.
13. Liability
- The Company is not liable for delays or non-performance due to force majeure or the Client’s fault.
- Temporary unavailability of the site does not entitle to compensation.
14. Personal Data and Confidentiality
- Compliance with GDPR (Regulation 2016/679) and the French Data Protection Act of January 6, 1978.
- Data collection is limited to order and client follow-up needs.
- Right to access, correct, and delete data upon written request.
15. Cookies and Tracking Technologies
- Cookies are used to improve browsing experience.
- The User can configure their browser to block cookies.
16. Intellectual Property
All content on the site (texts, images, trademarks, design, software) is protected by intellectual property laws. Any reproduction or use without permission is prohibited.
17. Transaction Security

- The Company never stores banking data.
18. Mediation and Dispute Resolution
- In case of a dispute, an amicable resolution will be attempted first.

20. Applicable Law
These T&Cs are governed by French law. Only the French version is legally binding.
